Agreement

• We advise you to read our Terms of Service carefully and understand them well. All clauses in the Terms of Service of Betka11 are delineated below and included in the medium of reference that can be accessed by clicking on the related links.
• You should ensure that you have read and understood our Agreement, including our Terms of Service, well before becoming a member of Betka11. By registering on Betka11, you agree to follow our Terms of Service, Privacy Policy, and Game Rules.
• You are completely bound by our Agreement when you choose to use our Services, Games, or software.
• We reserve the right to modify and amend our Terms of Service at any time. When we make changes, we shall inform you about the revisions by sending a notice to your registered email address and updating such changes on our Website.
• Changes may be made to review or change any of our Policies and Game Rules. If you do not agree to the changes, you may cease your use of our Services by informing us that you have deleted your account. Continuing to use our Services after any amendments will imply your acceptance of the changes made in the Agreement.

Warranty

• Betka11 aims to provide information that is accurate, complete, and reliable at the time of publishing. However, Betka11 makes no representations about the correctness, completeness, or suitability of any information published on its Website or contained in its documents.
• All information and related graphics are provided on an “as is” basis without warranty of any kind, express or implied. Betka11 disclaims all warranties regarding such information, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
• Betka11 does not provide any warranty or representation regarding the quality, fitness for purpose, completeness, merchantability, non-infringement, or accuracy of the Software, Website, and Games.
• Betka11 makes no warranty that its Software, Website, Games, or Servers shall be uninterrupted, timely, or error-free. Betka11 reserves the right to determine, at its sole discretion, responsibility for any malfunction or disruption.
• Betka11 reserves the right to limit your tournament/game participation or terminate your account if it determines you have intentionally caused such a malfunction. Betka11 is not liable for potential winnings from any unfinished tournaments or Fantasy Cricket games.

Use of Software

• Commercial use of our Software is strictly forbidden. Users are only allowed to use the Software for personal entertainment.
• Users may not attempt to modify, decompile, reverse-engineer, or disassemble the Software in any way.
• The use of artificial intelligence, including robots, is strictly forbidden in connection with the Software and the Games. All actions related to Fantasy Cricket games must be executed personally by Users using the user interface accessible through the Software.

Your Password, Your Responsibility

• After registering on our Website, it is solely your responsibility to keep your password confidential.
• Do not share your password with anyone. We are not responsible if your user account is accessed by someone else using your password.

Eligibility and Jurisdiction Policy

• Our Contests are open only to persons aged 18 or older and residing in India at the time of participation.
• Betka11 may bar people residing in certain Indian states from participating in Contests. Currently, residents of Assam, Andhra Pradesh, Odisha, Telangana, Nagaland, and Sikkim may not participate in any paid or cash Contests due to local laws.
• Every participant must have a valid email address and successfully register on Betka11 before participating in any Contest.

Breach and Consequences

• In the event of a breach of any Terms of Service, we may, at our sole discretion:
  • Restrict games between users suspected of collusion or cheating.
  • Permanently freeze your user account.
  • Seize the money in your user account.
  • Demand damages for breach and take appropriate civil action, or initiate prosecution for violations.
• In the event of a material breach, we reserve the right to bar you from future registration on the Website.
• The decision of Betka11 Management regarding actions taken as a consequence of breach shall be final and binding on you. Actions taken by Betka11 shall be without prejudice to other rights and remedies available in law or equity.

Governing Law, Dispute Resolution, and Jurisdiction

• This Agreement shall be governed and interpreted in accordance with the laws of India.
• All disputes, differences, and complaints shall be subject to arbitration under the Indian Arbitration and Conciliation Act, 1996.

Content

• All content and material on the Website, including information, images, marks, logos, designs, text, hyperlinks, multimedia clips, animations, games, and software (collectively referred to as “Content”), are protected by applicable intellectual property laws.
• All chat content, messages, images, and recommendations sent by Users can be logged/recorded and shall form part of Content. Betka11 is free to use this material in any manner.
• Our Website may contain hyperlinks to third-party sites. We are not responsible for the content on such websites and do not provide any warranty of the accuracy or quality of that content. You may rely on third-party content at your own risk.
• If you visit a third-party website through any content on Betka11, you will be subject to the terms applicable to that content. The existence of a link does not imply endorsement by us.

Contest Formats

• Betka11 provides Contests in two formats:
  1. Public Contests : Open to all Users without restrictions.
  2. Private Contests : Restricted to invited Users.

Public Contests

• Public Contests may comprise 2, 3, 5, 10, 100, or any other pre-designated number of Participants.
• The winner will be determined at the end of the round.
• A Contest becomes operational once the number of Participants equals the pre-specified number. If not, Participation Fees will be credited back without charges.
• In “Confirmed Contests,” they become operational once the number of Participants meets the specified number of winners, even if all slots are not filled. Participants can join until slots are filled or the round commences. Fees will be credited back if the Contest is not operational by round start.

Private Contests

• Users can create Private Contests and invite specific Users to participate.
• A Private Contest can have a specified number of Participants (2, 3, 5, or 10).
• The creator must pay the Participation Fee, name the Contest, and receive a unique Fantasy League Code.
• Changes to the Private Contest terms are only allowed for the name.
• Invited Users must input the Contest Code and pay the Participation Fee to join.
• If the pre-specified number of Participants is not reached 1 hour before the round, Participants can convert it to a Public Contest. This conversion is not guaranteed.
• If the number of Participants is still insufficient at the round’s start, the Contest will not be operational, and fees will be credited back without charges.
• Participation in Private Contests is subject to the specified number of Participants. Betka11 is not liable for any inability of invited Users to participate for any reason.

Indemnity

• To the extent permitted by law, in consideration for using our Services and participating in our Contests, you agree to indemnify, hold harmless, and defend us from any claims, actions, suits, damages, or losses, including litigation costs and attorney’s fees, arising from:
  • Infringement of intellectual property rights by your publication of any Content on our Website.
  • Defamatory, offensive, or illegal conduct by any player, or any misleading, inaccurate, or illegal content.
  • Use, abuse, or misuse of your user account on our online Fantasy Cricket Website.
  • Technical failures, system breakdowns, or adverse technological occurrences affecting your access to or use of our Website.
  • Access to your user account by any other person using your username or password, with or without your authorization.

GST Deduction Policy

• Goods and Services Tax (GST): A 28% GST is automatically deducted from your deposit into your betka11 account. This amount is credited back to you as discount points for use in the app.

• Discount Points:

  • Issuance: GST deducted at deposit time is converted to discount points and credited to your account.
  • Validity: Discount points are valid for 90 days from the credit date. Unused points expire after this period.
  • Usage: Points can cover entry fees for paid contests and other game-related expenses.
  • Match Cancellations: Points deducted for cancelled or abandoned matches will be returned to your Discount Point Account.

Governing Law and Jurisdiction

Our Terms of Service and Privacy Policy are governed by the laws of India. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the civil courts at New Delhi.

Refund Policy

• All deposits, purchases, and fees paid on betka11 for Fantasy Cricket are final. We review only error-oriented transaction cases.

• If you believe there was an error in any transaction, notify us within 3 working days from the transaction date. We will review your request and, if satisfied, initiate a refund within 7 working days. The refunded amount will be credited to your registered bank account within 10 working days after the refund process begins.

• Betka11 reserves the right to cancel any match and refund all fees paid within 1-3 working days.

• Users are prohibited from joining any game room after the match associated with that game room has started.

• All transactions and refunds are secure, as betka11 Gaming Private Limited solely owns betka11, ensuring no third-party involvement.

Legality

• Playing games of skill is legal under Indian law, and is excluded from the Public Gambling Act of 1867. The Supreme Court of India has ruled that games where success is primarily dependent on skill (such as knowledge, training, and strategy) are classified as games of skill.

• betka11 contests are games of skill. Participants must use their knowledge of cricket, football, or kabaddi, including player statistics and game conditions, to create well-balanced teams and make strategic decisions to succeed.

Fantasy Score and Feeds

• Betka11 obtains score feeds and data for score point computation from third-party providers. If any errors arise due to incomplete or inaccurate feeds, Betka11 will make efforts to correct them before prize distribution but does not guarantee the accuracy of third-party data.

• Users agree not to make claims against Betka11 for errors in scores, statistics, or winner selection resulting from third-party inaccuracies.

• The “Starting Line-up” feature aims to assist users in selecting their team based on available data. Users should do their own research, as Betka11 is not liable if a player indicated as “Playing” does not actually play.

Bonuses and Promotions

• Free Bonus: This bonus is initially credited to your Bonus Account. It gradually transfers to your Balance Account at 4% of the match fee for each Fantasy Cricket game room you join and complete, whether you win or lose.

• Instant/Deposit Bonus: This bonus is credited to your account immediately upon deposit, and you can use it in full for gameplay.

• Friend Referral Bonus: For each friend you refer who plays a cash game, you receive an Instant Bonus after they deposit money and play a game.

• Free Money Prize: In certain game rooms, you can join without paying an entry fee and still win a cash prize, such as entering a Rs. 500 prize room for free and winning the cash prize.

Bonuses & Terms and Conditions

• Deposit Bonuses : Added to a designated bucket for promotional use.

• Promotional Winnings : Winnings from Freeroll contests are also added to this bucket.

• Sign-up and Referral Bonuses : These are credited once a user makes a minimum deposit of ₹1.

• Usage Restrictions : Users cannot join Private Contests with this cash amount and cannot withdraw cash from this bucket.

• Score : Funds in this bucket are transferred to the Winnings/Withdrawable bucket only when the user converts to a cash player by depositing cash and playing a cash game.

Prizes: Terms and Conditions

• Users can win multiple prizes in a single day.

• Betka11 will notify all winners via email within 24 hours after the match ends.

• If a user wins multiple prize rooms in a day, they will receive the prize for the first room they joined, while the second-highest scoring users in other rooms will win prizes.

• Each user is allowed only one entry in any Free Entry-based prize room. Multiple accounts are not permitted.

• Freight, shipping charges, and customs duties on all prizes are the winners’ responsibility.

• All prizes are subject to TDS deductions as per the Income Tax Act, 1961. TDS certificates will be provided, and winners are responsible for any additional applicable taxes (income tax, gift tax, etc.).

User Acknowledgment

• By downloading or using the Betka11 application, users acknowledge that Betka11 and its subsidiaries are not responsible for the application or its content. Use is limited to personal, non-transferable purposes.

• Betka11 does not warrant the Website or its content. Users are solely responsible for any claims, liabilities, losses, or damages incurred through the use of Betka11 products and services.

• Betka11 is not liable for third-party intellectual property infringement claims related to users’ possession or use of third-party materials.

Eligibility

• Users from all states and union territories of India can participate, except for those in Assam, Andhra Pradesh, Odisha, Telangana, Nagaland, and Sikkim.

• All standard terms and conditions of Betka11 apply.

• The decision of Betka11 management is final and binding in case of any disputes.

Refund for Clash Policy

• Refunds are applicable only for contests with a maximum of 4 spots and single entry only.
